ENVIRONMENTAL ASSESSMENTS

      Phase I thru Phase III

Environmental Site Assessments are performed by TTI’s staff for a wide variety of clients.  The assessments are performed for real estate sales, collateral borrowing, property acquisitions, lease/tenant agreements and foreclosure.  The process is initiated by the performance of a Phase I Environmental Site Assessment.  Phase I’s are conducted in accordance with applicable client protocol as well as the Technical Requirements established by American Society of Testing Materials (ASTM).  The Phase I process is intended to satisfy one of the requirements to qualify for innocent land owner defense to Comprehensive Environmental Response, Compensation and Liability Act (CERCLA).

The Phase I Environmental Site Assessment is conducted in accordance with ASTM's accepted Protocol and shall generally consist of the following activities:

      .     Physical inspection, walk-through and drive of the property and of all facilities and improvements on the real property including an investigation of any chemical use, storage, treatment and disposal practices on the property to determine potential areas of environmental concern (i.e., hazardous materials mishandling, underground storage tanks, surface water condition, spills and disposal areas).

      .     Drive of the area surrounding the property to identify any potential sources of off-site environmental contamination that could affect the subject property.

      .     Review of reasonably obtainable Federal, State and local government records of sites or facilities in order to determine if there has been a release of hazardous substances on the subject property or which are likely to cause or contribute to a release or threatened release of hazardous substances on the subject property.

      .     Review of historical aerial photographs which may reflect prior uses of the real property and which are reasonably obtainable through State and local government agencies.

      .     Review of the recorded chain of title documents regarding the real property, including all deeds, easements, leases, restrictions and covenants for a period of 50 years to investigate past ownership and former use. 

      .     Asbestos Building Survey (Optional).

      .     Consultation and liaison with client.

      .     Preparation of a report with recommendations concerning the need to conduct soil, surface water and/or groundwater sampling and analyses to identify and/or delineate areas of environmental concern.

If recognized areas of environmental concern are identified, many properties are subjected to further evaluation by performing an intrusive site investigation.  These activities are commonly referred to as Phase II Environmental Site Assessments.  Phase II’s involve the collection of environmental media (i.e., soil, groundwater) for laboratory analysis, geophysical surveys, integrity evaluations, etc.

ISRA CASE MANAGEMENT

The New Jersey Industrial Site Recovery Act (ISRA) imposes certain preconditions on the sale, transfer or closure of an industrial establishment involved in the generation, manufacturing, refining, transportation, treatment, storage, handling or disposal of hazardous substances or wastes.

The NJDEP inspects and identifies areas of environmental concern.  These areas must be delineated and adequately cleaned up under ISRA Program Guidelines.  All investigations are performed in accordance with the NJDEP's Technical Requirements for Site Remediation (N.J.A.C. 7:26E).

LEAD BASED PAINT INSPECTIONS

TTI’s certified Lead Inspector/Risk Assessors utilize a portable X-ray fluorescence (XRF) spectrum analyzer to test painted surfaces in all interior and exterior building areas and components on a room‑by‑room basis.  Areas typically tested include, but are not limited to, interior walls, baseboards, ceilings, floors, interior doors, door trim, etc. 

The survey protocol used to identify lead based paint is designed in accordance with the guidelines developed by the United States Department of Housing and Urban Development (HUD) and the Performance Characteristics Sheets (PCS) developed by HUD and the United States Environmental Protection Agency (USEPA).  The statutory and regulatory requirements can be found in Section 302 of the Lead‑Based Paint Poisoning Prevention Act (LBPPPA).  

HUD defines lead based paint, when analyzed by a portable XRF, as paint with a lead concentration of greater than or equal to 1.0 mg/cm2.  It should be noted that Occupational Safety and Health Administration (OSHA) Regulations apply to any detectable concentrations of lead in paint. 

Each building to be tested is separated into room equivalents (i.e. hall, family room, dining room, etc.).  Each room equivalent is further divided into components (i.e., floor, wall, ceiling, trim, etc.)  Building components are segregated by color (i.e., white, off-white, etc.) and substrate (i.e., metal, wood, drywall, etc.).  These four (4) criteria compose a testing combination.  Three (3) XRF readings are obtained for each testing combination. 

TTI personnel who operate the XRF spectrum analyzer are properly trained by the manufacturer in all safety measures and testing protocol.  Manufacturer's operating instructions as well as the HUD Testing Guidelines are followed by survey personnel. 

The XRF readings are recorded directly on XRF Data Sheets and compiled into a detailed final report.

UNDERGROUND STORAGE TANK (UST) MANAGEMENT

The company has provided services for all management phases of underground (UST) and aboveground (AST) storage tank systems since its inception.  The company provides all services necessary to cleanup and resolve soil and groundwater remediation problems.  The TMS division interacts with the Environmental Consulting (EC) division for expertise in soil and groundwater remediation projects.  All of these services are in-house using TTI professionals.

 Specifications/Reporting

      Bid specifications are developed for the removal or abandonment of USTs.  TTI distributes the bid documents to perspective contractors and attends all bid meetings.  TTI reviews all bids submitted and recommends a contractor to be selected.  Pre-construction meetings with selected contractors will be held and construction schedules will be developed.  TTI supervises the initial UST removal performed by the selected contractor.  TTI performs the site investigation (SI) which includes post excavation soil sampling/laboratory analysis.  TTI will prepare an UST closure report and will submit it to the NJDEP. 

Subsurface Evaluation

This can be accomplished through the placement of soil borings/probeholes and temporary groundwater well points to collect soil/groundwater samples for laboratory analysis.  The analytical results would be compared to current NJDEP Soil Clean-Up Criteria and Groundwater Quality Standards.

         TTI's Tank Management Services

NJDEP CLEANUP STAR

The New Jersey Department of Environmental Protection’s Cleanup Star Program allows pre-qualified environmental professionals to investigate and remediate certain properties and areas of concern with limited NJDEP oversight.  Under the Cleanup Star Program, the NJDEP has established strict criteria for the pre-qualification of environmental professionals.  The criteria have been designed to identify individuals whom by virtue of education, experience, and third party certification can be assumed to be sufficiently competent and trustworthy for the Program.  These individuals will be known as "Cleanup Stars."

Over 450 individuals applied for the Cleanup Star Program.  243 individuals representing 110 firms have been qualified as Cleanup Stars.  TTI employs two (2) approved Cleanup Stars, Vice President Craig Durand and Senior Project Manager Perry Refolo.

The NJDEP will rely on Cleanup Stars to investigate and remediate qualifying sites with limited direct NJDEP oversight.  By doing so, NJDEP case managers will be available to focus on the more contaminated and complex sites.  By establishing and strictly enforcing the requirements of the Cleanup Star Program, NJDEP can ensure that remediation of contaminated sites is completed in full compliance with the Technical Requirements for Site Remediation and other applicable standards.  Cleanup Star oversight will allow uncontaminated or slightly contaminated property to go quickly through the NJDEP process, allowing the properties to be sold or reused for important new purposes.
